Totes to Go LLC

Please read these Terms of Service ("Terms") carefully before using the services provided by Totes to Go LLC ("we," "us," or "our"). By accessing or using our website, placing an order, or engaging with our services, you agree to be bound by these Terms.

1. Services

1.1 Totes to Go LLC provides rental moving totes for customers in Kearney, Nebraska, and surrounding areas. Our services include the delivery and pickup of plastic totes for moving and storage purposes.

1.2 By using our services, you acknowledge that the rental period begins upon delivery and ends when we retrieve the rental totes from the specified location.

2. Rental Agreement

2.1 By placing an order, you agree to enter into a rental agreement with Totes to Go LLC. You understand that the rental totes remain our property at all times.

2.2 You are responsible for the rented items during the rental period and must take reasonable care of them. Any loss, damage, or excessive wear to the rental totes may incur additional charges.

2.3 Customer acknowledges that (s)he has care, custody and control of the Totes to Go totes while the totes are at the Customer's location. Customer accepts responsibility for all loss or damage to the totes. If the totes are damaged or lost while in the Customer's possession the customer will be obligated to pay the full retail value of the totes. Retail value of the totes is $25.00 for each damaged or lost tote.

2.4 Customer acknowledges that (s)he has care, custody and control of the Totes to Go dollies while the dollies are at the Customer's location. Customer accepts responsibility for all loss or damage to the dollies. If the dollies are damaged or lost while in the Customer's possession the customer will be obligated to pay the full retail value of the dollies. Retail value of the dollies is $80.00 each.

2.5 Customer acknowledges that (s)he has sole responsibility to have the Totes to Go totes and dollies available for pickup by the agreed upon date. For each additional day that the totes are not returned there will be an additional rental charge of $0.35 per day per tote. If the totes are not returned after 30 days and there has been no communication to extend the rental, it is assumed that the customer wishes to purchase the totes and will be charged the full retail value at a rate of $25.00 per tote. If the dollies are not returned after 30 days and there has been no communication to extend the rental, it is assumed that the customer wishes to purchase the dollies and will be charged the full retail value at a rate of $80.00 per dolly.

3. Delivery and Pickup

3.1 We will make reasonable efforts to deliver the rental totes to the specified location and retrieve them at the end of the rental period as agreed upon during the ordering process.

3.2 It is your responsibility to ensure that someone is present at the designated delivery and pickup address during the scheduled time slots. If no one is present and we have not been contacted in advance, a rescheduling fee of $25 will apply. Additional scheduling attempts will incur the same fee.

4. Use of Rental Totes

4.1 The rental totes provided by Totes to Go LLC are intended for moving and storage purposes only. They should not be used for any illegal or hazardous activities.

4.2 You are responsible for packing the rental totes appropriately, ensuring that the weight limits are not exceeded, and that no prohibited items are placed inside the totes.

5. Payments and Fees

5.1 Rental fees and any applicable charges will be clearly stated during the ordering process. By placing an order, you agree to pay the specified fees.

5.2 All payments must be made in the currency specified on our website. We accept major credit cards or other forms of payment as indicated.

5.3 Late returns, damages, excessive wear, or failure to comply with these Terms may result in additional fees or charges, which will be communicated to you.

6. Limitation of Liability

6.1 Totes to Go LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with the use of our services or rental totes.

6.2 We make no warranties, express or implied, regarding the condition, quality, or fitness for a particular purpose of the rental totes or our services.

7. Privacy

7.1 We respect your privacy and handle personal information in accordance with our Privacy Policy. By using our services, you consent to the collection, use, and disclosure of your personal information as described therein.

8. Termination

8.1 We reserve the right to terminate or suspend your access to our services at any time, without prior notice or liability, for any reason, including, but not limited to, a breach of these Terms.

9. Governing Law

9.1 These Terms shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of laws principles.

10. Changes to the Terms

10.1 We reserve the right to modify or replace these Terms at any time. Any changes will be effective immediately upon posting on our website. It is your responsibility to review these Terms periodically for any updates or modifications.

By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these Terms, please refrain from using our website and services.
